1. About Changa-Fuel

Changa-Fuel ("Changa", "we", "us") is a Kenyan ride-sharing and cargo-matching platform operated by Changa Smart Commute. These Terms & Conditions ("Terms") form a binding agreement between you and Changa when you access www.changa.ke, changa.ke or any Changa mobile application (the "Platform").

2. Eligibility & Account

You must be at least 18 years old and legally able to enter contracts under Kenyan law. Drivers must hold a valid Kenyan driving licence, NTSA-compliant PSV or private insurance where applicable, and a roadworthy vehicle. You are responsible for keeping your account credentials confidential and for all activity under your account.

3. Nature of Service

Changa is a technology platform that connects commuters ("Riders") with private vehicle owners ("Drivers") sharing the same route, and senders with lorries transporting cargo. Changa is not a transport carrier. Trips are contracts between Riders and Drivers; Changa facilitates matching, payment, safety features and dispute handling.

4. Fares, Fees & Payments

  • Fares are quoted per seat in Kenyan Shillings (KSh) and include the applicable Birdview Personal Accident surcharge (KSh 10 per long-distance trip, KSh 5 per in-town trip).
  • Changa charges a platform fee of 8% on Rider payments, deducted before crediting the Driver wallet.
  • Payments are collected via M-Pesa STK Push, KCB Buni or wallet balance. All Kenyan tax obligations remain with the respective party.
  • Refunds for cancelled or unfulfilled trips follow the cancellation rules displayed at booking time.

5. Wallet & Withdrawals

Driver earnings and Rider top-ups are held in a Changa fuel-card wallet. Withdrawals are sent to the M-Pesa number on your verified profile. Minimum withdrawal is KSh 50. Changa may hold a withdrawal for review where fraud, insurance claims or chargebacks are suspected.

6. Insurance

Every verified Rider or Driver is automatically enrolled in a Personal Accident cover underwritten by Birdview Microinsurance while on a Changa trip. Cover terms, exclusions and claim limits are set by the underwriter. Vehicle, third-party and comprehensive motor insurance remain the Driver's responsibility.

7. Cargo Trips

Cargo bookings are OTP-secured at pickup and drop-off. Senders must declare goods truthfully; hazardous, illegal or restricted items are prohibited. Liability for lost or damaged goods is capped at the declared value or KSh 20,000 per consignment, whichever is lower, unless additional cover has been purchased.

8. User Conduct

You agree not to misuse the Platform, harass other users, provide false information, tamper with GPS or OTP flows, or use Changa for any activity that violates Kenyan law. Changa may suspend or terminate accounts that breach these Terms.

9. Safety & Panic Alerts

The in-app panic button notifies Changa safety operators and your emergency contacts. It is not a replacement for the Kenyan emergency services (999 / 112). Always call the police in life-threatening situations.

10. Limitation of Liability

To the maximum extent permitted by Kenyan law, Changa is not liable for indirect, incidental or consequential losses arising from trips arranged through the Platform. Nothing in these Terms excludes liability that cannot be excluded under Kenyan law.

11. Governing Law & Disputes

These Terms are governed by the laws of Kenya. Disputes will first be handled through Changa support (info@changa.ke) and, if unresolved, referred to arbitration in Nairobi under the Arbitration Act, 1995.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified in-app or by email. Continued use of the Platform after changes take effect constitutes acceptance.
